THAT I HAVE AT THE OWNERS CORPORATION MEETING OF 22 JANUARY 2018 tabled
documents in relation to a rescinded parking authority as the removal of
a notice by Gippsland Strata Management as addressed by AGENDA ITEM #2
{MINUTES OF PREVIOUS MEETING of 23 JANUARY 2017} and have a bearing upon
AGENDA ITEM #6 {DISCUSS ENTITLEMENT/LIABILITY} in relation to parking
breaches and an intention to make a claim against the Public Liability
Insurance [since withdrawn].
That the Strata Owners Corporate Managers at the 22 January 2018 annual
meeting had confirmed their agreement of all matters I had previously
and reasonably made including that of the year prior and the outrageous
conduct of others as wilful damages, assailment whether verbal or
physical, vilification have no substantiating grounds of factual cause
as being prejudiced:
#1 - The indiscriminate recharging of appliances which caused disruption
to the television transmission signal was a loss of amenity and
therefore prohibited.
#2 - COMMON ACCESS SECURITY DOORS MUST NOT BE IMPEDED WHETHER LOCKED OR
KEPT AJAR AND SUCH ACTS MUST IMMEDIATELY CEASE.
#3 - No action to be taken on the Southern fence at this stage. It was
agreed to increase the fees to $750.00 per lot owner from 30/11/18 to
cover full replacement of this fence and any issues arising from the
safety audit report.
That I had paid this $250 additional charge upon 23 January and no doubt
this will assist repairs of wilful damage to the fence occurring at 2330
hours on 28 January 2018 as revengeful act for a demand of compliance
given the Strata Management requirements.
#4 - I had requested a tenant only parking sign & no parking on the
grass be erected at the front. (Is to be arranged).
This was in lieu to its improper removal by Strata Management over a
year prior when they had affixed contact details of their management of
the property.
And a failure to comply with a written request dated 23 August 2017 to
re-affix this notice as so to resolve this unnecessary issue of parking
infractions as “corrective action [which] is sought so as promote a
conducive rapport between neighbours” was not heeded.
Thus it might be considered as a matter of legal liability applied
indirectly to a question of complicity apportioned by Strata
Management’s removal of a legal accountability as notice and a failure
to re-affix it which was then causal for the needless obstinate and
ill-informed conflict resulting in injury as a consideration which could
then be applied to the Strata Domestic Insurance Policy.
#5 - I had requested a copy of the liability insurance policy number to
investigate making a claim. Copies of related correspondence are
available upon request.
And this provides the material details of any legal claim should such an
eventuality arise.
#6 - I also asked for the nature strip bare patch to be top dressed.
This is to be organised and a contractor has been given the go ahead to
proceed asap.
